Definitions

The references to "we", "us" and "our" are references to Toyota New Zealand Limited, Toyota Financial Services Limited, Daihatsu and Lexus. References to "dealers" or "your dealer" are references to the authorised dealers of any of those companies.

Acceptance of these terms of use

By using this website, you accept these Terms of Use and are bound by them.  If you do not accept these Terms of Use, you should not use this website.

Additional terms may apply to specific goods or services or online tools or functions provided through or on this website. Where we indicate on this website that additional terms apply, you must read these Terms of Use in conjunction with those additional terms.  If there is any inconsistency between these Terms of Use and those additional terms, the additional terms will prevail (unless we expressly tell you otherwise).

Amendments to these terms of use

We may amend these Terms of Use in whole or in part from time to time.  Amendments will be effective immediately when we post the amended Terms of Use on this website.  You are responsible for ensuring you are familiar with the latest Terms of Use.  By continuing to use this website, you agree to be bound by the Terms of Use as amended (whether or not you have received any amendments).

Intellectual property rights in website

We (and our licensors or suppliers, as the case may be) own all intellectual property rights in this website, including all of the content of this website (such as text, graphics, logos, icons and sound recordings) and all software code underlying and forming part of this website.

Governing Law

This website and these Terms of Use is governed by the laws of New Zealand.  When you access this website, you submit to the exclusive jurisdiction of the New Zealand courts.

“RRP” means Recommended Retail Price. It is a recommendation only and there is no obligation on Toyota New Zealand nor Dealers to comply with the recommendation.

“TDP” means Toyota Driveaway Price.  Our Toyota Driveaway Price means just that, it's the total cost you will pay to drive away in your new Toyota. Toyota New Zealand Limited sets the price of the vehicle to include GST, pre-delivery costs, WoF/COF, registration, number plate, tank of fuel, floormats, 1000km RUC (if applicable) and TCSA.

Vehicle accessory prices shown are inclusive of estimated fitting costs unless otherwise specified. The estimated fitted price is based on factory fitment at time of order. The estimated price assumes a recommended selling price for the accessory plus an estimate for the labour required to implement the fitting. Actual Dealer fitted prices may vary from the prices stated. Some Toyota Genuine Accessories are not available for all models/grades. Accessories may require painting to match vehicle body colour. Tyre purchase and fitment are not included in the accessory wheel purchase price.

Toyota Group - Privacy and Credit Information Policy

  1. Who are we?

In this policy the “Toyota Group” (or “we” or “us”) is:

  • Toyota New Zealand Limited (“Toyota NZ”); and
  • Toyota Finance New Zealand Limited (“Toyota Finance”).

Please note that “Lexus” is a brand and division of Toyota New Zealand Limited.

We understand that your personal information and credit information (“information”) is important to you and we value your trust. This policy sets out how the Toyota Group handles your information. It also includes how we handle information collected from third parties, such as your credit report through the credit reporting system if you obtain finance with us.

We are bound by the Privacy Act 1993 (“Privacy Act”) and all supporting regulations.

The Toyota Group is part of the Toyota Network, which includes:

  • Toyota NZ;
  • Toyota Finance;
  • Authorised Toyota dealers in New Zealand; and
  • Aioi Nissay Dowa Insurance Company Ltd trading as “Toyota Insurance”;

The Toyota Group collects and shares with other members of the Toyota Network your personal information so that Toyota Network can provide you with an integrated Toyota guest experience including allowing you to be known across the Network regardless of which Toyota entity you choose to deal with and to provide you with products, services, information and assistance, respond to your enquiries and help keep your information up to date. Your information may be disclosed to Toyota Network service providers in New Zealand and overseas for these purposes.

  1. What information do we collect and hold?

The kinds of information that we collect and hold about you will depend on the nature of your dealings with us.

Information we collect about you: We may collect and hold information about you including:

  • Contact information and identification such as your name, date of birth, contact number(s), email address(es), residential and/or business address(es), demographic information (such as postcode, age, gender) and driver’s licence details;
  • Payment details (such as account or credit card details) and payment-related information in connection with your purchase of our products and/or services;
  • Vehicle and servicing details including vehicle registration, vehicle purchase details, name of your selling or servicing Toyota dealer, service appointment bookings, vehicle service and repair history (including in relation to Toyota Service Advantage, warranty, repairs and recalls, if applicable), data collected as a result on-board vehicle telematics;
  • Finance details such as financial, insurance or credit information, marital status, employment details and history; and
  • Information collected from marketing campaigns, product research, customer surveys, your interactions with us including via social media, or publicly available information that you post or publish.

If you do not wish to provide particular information, we may not be able to respond to your query, provide you with our products and services or assess your application for a product or service.

Sensitive information: We will only collect sensitive information about you with your consent (unless we are otherwise allowed or required by law to collect that information). Sensitive information includes information about your health, race, ethnic origin and religious beliefs.

Providing someone else’s personal information: If you provide us with personal information about another person (such as a joint vehicle owner or authorised driver or contact person), please tell them about this Policy so they are aware that you have provided their information to us and that they can read this Policy to understand how their information will be handled.

  1. Information we collect automatically

Whenever you visit or interact with a Toyota Group website or other online platform of ours (“Platforms”), we, as well as any third-party service provider and/or advertiser, may use a variety of technologies that automatically or passively record information about how the Platform is accessed and used (“Usage Information”). Usage Information may include your IP address or other unique identifier for the device used to access a Platform ("Device Identifier"), browser type, “Device” type (computer, mobile phone, tablet or other device), operation system, application version, date and time of visit, pages viewed, preceding page views and your use of features or applications on the Platform such as interactions with connections or groups.

Usage Information helps us keep our Platforms relevant to users and allows us to tailor content to a user’s interests. Usage Information is generally non-identifying, but if we associate it with you as a specific and identifiable person, we will treat it as personal information.

We may use Device Identifiers to help us administer Platforms, diagnose problems with our servers, analyse trends, observe Platform usage and activity over time, help identify you and your shopping cart, and gather broad demographic information for aggregate use.

Cookies (data files placed on a Device when it is used to visit a Platform) may be used to associate you with social media platforms like Facebook and, if you so choose, enable interaction between your activities on our Platforms and those social media platforms. We or our vendors may place cookies on your Device for security purposes, to facilitate site navigation and personalise your experience while visiting our Platforms (such as allowing us to select which ads or offers are most likely to appeal to you, based on your interests, preferences, location or demographic information).

To learn how you may manage cookies, or delete cookies that have already been installed, please refer to your browser’s help menu or instructions. If you disable or opt out of receiving cookies, some features and functions on our Platforms may not work properly or fully because we may not be able to recognise and associate you with your Toyota account(s). In addition, the offers we provide may not be as relevant to you or tailored to your interests.

Remarketing: We use Google Adwords Remarketing to advertise our products and services online. Third party vendors, including Google, use cookies to display relevant ads based on your past visits to our website(s). Google Remarketing allows us to tailor our marketing to better suit your needs and display ads that are relevant to you. We respect your privacy and any data collected will be used in accordance with this privacy policy, Google's privacy policy or the privacy policy of other remarketing services that we may use.

If you do not wish to participate in our Google Adwords Remarketing, you can opt out by visiting Google's Ads Preference Manager (myaccount.google.com/u/0/privacy?pli=1#ads). You can also opt out of any third party vendor's use of cookies by visiting the Network Advertising Initiative opt-out page www.networkadvertising.org

  1. How do we collect your information?

We may collect information in a variety of ways, including directly from you, for example:

  • When you complete a form to order a vehicle, parts or accessories, book your vehicle for servicing, apply for credit or make a general enquiry about our products and services;
  • When you contact or interact with us whether in person, by email, phone, SMS or other forms of communication, or via our website or social media;
  • When you use data-collecting devices, products or systems; or
  • When you participate in our surveys, competitions, promotions, events, sponsorships or other activities.

We also collect personal information about vehicle owners from the Motor Vehicle Register, in accordance with our authorisation to access the Motor Vehicle Register for specified purposes under section 241 of the Land Transport Act 1998.

We may collect information from organisations within the Toyota Network, such as:

  • Our authorised Toyota dealers, if you interact with or purchase products or services from that dealer;
  • Toyota Insurance, if you make enquiries, purchase and/or renew your insurance with Toyota Insurance.

Sometimes, we may collect your information from third parties such as:

  • Providers of data-collecting devices, products or systems that you use;
  • Your accountant for the purposes of assessing a credit application;
  • Where an individual is an officer of a company that has applied for credit, we may collect information about the officer from public records or from other officers of the company who arranged that company's credit application;
  • When named as a personal referee by you, we collect that personal referee's personal information from the written credit application form;
  • Another credit provider where you have or had a credit account;
  • The Credit Reporting Body (“CRB”) where we obtain your credit report;
  • Your insurer or broker;
  • Contractors performing a service or function on our behalf;
  • Regulatory authorities;
  • Marketing agencies and similar lists which are legally acquired by us; and
  • Any other parties you refer us to or who refer us to you.
  1. What are the purposes for which we collect, hold, use and disclose your information?

The Toyota Group collects, holds, uses and discloses your information for a variety of purposes including:

  • To provide you with an integrated Toyota experience;
  • Any purpose which we notify you about when we collect your information or to which you have provided your consent;
  • Considering and assessing your application for a product or service;
  • Providing a Toyota product or service to you (including via our authorised Toyota dealers, agents and/or contractors where applicable);
  • Providing customer assistance and support such as vehicle service reminders, recalls and assisting with warranty claims;
  • Responding to your enquiries, concerns or complaints;
  • Administering and managing our relationship with you, including by verifying your identity in order to provide a requested service;
  • Informing you about products, services, special offers and/or events from the Toyota Network. For more on Direct Marketing, see section 6 below;
  • Improving your customer experience and our marketing, including through data analytics, product planning, product development and research;
  • Protecting our interests, including by registering a security interest on the Personal Property Securities Register or checking against sanctions or other reference lists;
  • Complying with our legal obligations, assisting government and enforcement bodies or regulators, or where otherwise required or authorised by or under law, or an order of a court or tribunal; and
  • Assessing and considering your application (if applicable) as a prospective job applicant, dealer/franchisee or contractor.

We may publish (including by posting on social media) customer testimonials/video testimonials which may contain personally identifiable information. We will obtain the customer’s consent prior to publishing the testimonial along with their name.

  1. Direct marketing

The Toyota Network (or any of the entities which make up the Toyota Network including their agents and contractors if any acting on their behalf) may send you direct marketing to inform you about products or services, special offers, promotions and events that may be of interest to you. These marketing communications may include joint promotions with Toyota dealers or other promotion partners, and may be sent to you using any contact details provided by you, such as post, phone, email or SMS.

Please note that the organisations comprising the Toyota Network are separate organisations. If you do not wish to receive marketing communications and surveys from a member of the Network, you can let that organisation know at any time using the contact details in their respective privacy policies or utilising the “unsubscribe” or other opt-out function offered by the organisation.

If you do not wish to receive any marketing communications from Toyota NZ or Toyota Finance, you can let the relevant organisation know using the contact details provided in section 14 “Contacting us” below, or by utilising the “unsubscribe” function in electronic communications from the organisation. In some circumstances we may need to contact you to obtain additional information, verify your identity or to clarify your request, in order to action it.

Your consent to receive direct marketing communications from the Toyota Network in the above ways will be deemed if you do not opt out when you are offered the opportunity to do so, and will remain current on an ongoing basis unless and until you advise otherwise.

If the law requires us to provide you with information about our products or services (for example, product recalls), we will provide that information even if you have elected not to receive information about our products and services generally.

  1. Who do we disclose your information to?

We may share your information within the Toyota Network in order to provide an integrated Toyota guest experience across our Network.

Your vehicle logbook data, and service and repair history (including in relation to warranty and recalls, if applicable) may be made available to subsequent owners (if any) of your vehicle. We do not disclose any personally identifying information about you to subsequent owners of your vehicle.

We may disclose your information to others including:

  • The Toyota Group’s related bodies corporate (including our parent company Toyota Motor Corporation in Japan);
  • Other credit providers to assess your application with Toyota Finance or manage your credit;
  • A guarantor, if a finance arrangement is guaranteed;
  • Our agents or contractors which perform a particular function or service on our behalf;
  • Government and law enforcement agencies, bodies and regulators, or a dispute resolution body of which we are a member (for example, the Insurance and Financial Services Ombudsman), if we are required to disclose your information to such authorities; or
  • Your employer or former employer (for example, to conduct a reference check for potential employment or finance applications).

Examples of our third party agents or contractors include:

  • Mailing houses;
  • Printers;
  • Organisations that assist us to conduct promotions or market research;
  • Customer support providers;
  • Information technology service providers;
  • Debt collection agencies; and
  • Accountants, lawyers and other professional advisors.

We may also disclose your information to third parties where required or authorised by or under law.

We will not sell, pass on, or share any information you provide to us any third parties that are not part of the Toyota Network.

  1. Facebook Advertising

We may market to you via your Facebook feed based on information we hold about you, such as your email address and phone number.

We provide personal information such as your email address and phone number to Facebook to enable Facebook to determine if you are a registered account holder with Facebook. You may opt-out of receiving advertisements from us via your Facebook ad preferences, or by sending an email from the email address you are opting out of, to the email address provided in our contact information below.

For your opt-out to be effective, you must:

  • place the following text in the subject line of the email - "Opting Out of Facebook Ads", and
  • in the body of the email, include your name and email address. We will ensure that you name and email address are removed from any future Facebook ad campaigns.
  1. Credit reporting (applies only if you seek finance from Toyota Finance)

In this section, references to “we”, “us” or “our” refer to Toyota Finance only, not Toyota NZ. Toyota Finance participates in the comprehensive credit reporting system to make better and more informed decisions about providing credit to our customers. When you apply for credit with Toyota Finance, or propose to be a guarantor, we may request a credit report about you from a CRB. Credit reports contain information about your credit history that will help us assess your credit worthiness and your ability to repay credit.

What credit information and credit eligibility information do we collect and hold?

The credit information we collect and hold includes your identification details, the type of credit you hold, the amount of credit borrowed, the terms and conditions of your credit, when your credit was opened or closed, whether or not you have met your repayment obligations under your loan contract and loan contracts with other credit providers, and information about your credit worthiness. The credit eligibility information we collect and hold includes credit reports obtained from a CRB and our own rating or score which help us to assess your creditworthiness.

What do we do with credit information and credit eligibility information?

We collect, hold, use and disclose credit information and credit eligibility information about you for purposes which include:

  • confirming your identity;
  • assessing your consumer or commercial credit or guarantor application;
  • managing your account and collecting any overdue payments;
  • helping you avoid defaulting on your loan;
  • complying with any relevant laws and regulations.

We will use the information obtained from a CRB, and combine it with information we already hold about you, to calculate our own rating or score to help us assess your creditworthiness.

We may also disclose to the CRB if you have not met the payment obligations under your loan contract or if you have committed a serious credit infringement (for example fraud). Some of the information we disclose to a CRB may be included in your credit report and provided to other credit providers to help them assess your creditworthiness.

What are your rights?

You have the right to ask a CRB not to use your information for the purpose of pre-screening or direct marketing by a credit provider. You can ask them not to use or disclose this information for a period of time if you reasonably believe that you have been, or are likely to be, a victim of fraud.

  1. Holding and protecting your information

We may hold information about you in digital and paper forms. We take reasonable steps to protect your information from misuse, loss, interference, and from unauthorised access, modification or disclosure. Some of the ways we protect your information include:

  • External and internal premises security;
  • Restricting access to your information only to personnel who need it to perform their functions;
  • Utilising and maintaining information security applications to prevent unauthorised access or damage to electronically stored information, such as requiring identifiers and passwords, firewalls and anti-virus software; and
  • Maintaining physical security over paper records.
  1. Disclosing your information overseas

We may disclose your information to organisations located overseas. These include:

  • Our related companies in Japan and elsewhere in the world; or
  • our service providers that are located or hold data overseas including in the USA, Singapore, the UK and Sweden.
  1. Accessing and correcting your information

You can generally access and request the correction of information we hold about you by contacting us in any of the ways set out at the bottom of this policy. Please note that the organisations comprising the Toyota Network (that is, each of Toyota NZ, Toyota Finance, each Toyota Dealer, and Toyota Insurance) are separate organisations, and each organisation may hold different information about you (if any).

Access to your information may be refused in a number of circumstances, such as where the information relates to anticipated legal proceedings or if the request for access is frivolous or vexatious. If we deny or restrict your access, we will write to you to let you know why, unless, having regard to the grounds for the refusal, it would be unreasonable for us to do so. You may make a complaint about a refusal to the Office of the Privacy Commissioner.

We rely on the information that we hold about you to provide our products and services to you, and to perform our business functions. Therefore, it is very important that the information we hold is accurate, complete, up to date and relevant. This means that, from time to time, we may ask you if your information is still accurate and up to date. If you find that any information that we hold about you is incorrect, you should contact us immediately and we will take reasonable steps to correct it.

  1. Resolving concerns

If you believe that your privacy has been compromised, or if you feel that we have breached the privacy laws, you are entitled to make a complaint. Complaints can be made by contacting the person or department you were dealing with, or by contacting us using our contact details set out at the bottom of this policy.

We endeavour to respond to you within 24 hours to acknowledge the complaint and explain how we will investigate it. This may include consulting with the CRB or other credit providers if the complaint relates to your credit information. We will try to resolve your complaint within 20 working days and write to you to explain the reasons for our decision. When this is not possible, we will contact you and let you know how long it will take for us to resolve your complaint.

If your complaint is not satisfactorily resolved, you can contact us to discuss your concerns or lodge a complaint with Office of the Privacy Commissioner by visiting www.privacy.org.nz, calling 0800 803 909 or using the online complaint form. If your complaint relates to your finance with us you may access the Insurance and Financial Services Ombudsman Service at www.ifso.nz or by calling 0800 888 202.

The following General Terms and Conditions apply to all prize draws on this website, unless otherwise specified.

  1. Entry into the specific prize draw is deemed acceptance of these general terms and conditions and any specific or additional terms and conditions as outlined below.
  2. Employees of Toyota New Zealand Limited, Toyota Financial Services Limited, their advertising agencies, subsidiaries, Toyota dealership staff, and their immediate families are not eligible for this prize draw.
  3. Entry into this prize draw is deemed consent that you have opted into further communication from Toyota New Zealand Limited. You will have the ability to opt-out at any time by calling 0800 TOYOTA (0800 869682) or by emailing customercare@toyota.co.nz
  4. Proof of purchase and photo ID may be required to claim the prize.
  5. Toyota New Zealand Limited cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.
  6. The prize winner will be the first valid entry randomly drawn from eligible entries received within the term.
  7. The prize winner will be notified within 5 working days of the draw and contacted via a call to the phone number provided or that made the entry.
  8. The person whose phone is used to submit the entry is deemed the entrant in the event of any dispute.
  9. Prizes are not transferable, exchangeable nor negotiable and are not redeemable for cash.
  10. While this prize draw will be administered with all reasonable care and skill, if Toyota New Zealand Limited or its designated agents are unable to make contact with any winner within 5 working days of a draw, Toyota New Zealand Limited reserves the right to declare that entry invalid and draw a new winner on the same terms and conditions as the original draw.
  11. Toyota New Zealand Limited reserves the right to substitute prize components of equivalent or greater value if any prize becomes unavailable.
  12. Toyota New Zealand Limited accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries. Toyota New Zealand Limited does not warrant that the entry mechanism will be available at all times during the Promotion Period.
  13. Incomplete or incorrect entries are not eligible to win.
  14. By entering the prizedraw, the winner consents to Toyota New Zealand Limited publishing comments anonymously and summarised scores in customer communications, Toyota websites and in social media channels.
  15. By entering, prize winners agrees to be available for reasonable publicity purposes without compensation, including but not limited to photographs and interviews. Entrants acknowledge that their details may be published in various media.

  20. All decisions made by Toyota New Zealand Limited are final and no correspondence will be entered into.

Toyota Care Service Advantage (TCSA) Terms and Conditions

The following General Terms and Conditions apply to the Toyota Care Service Advantage (TCSA) offer:

      1. “We” “us” “our” or “Toyota” means Toyota New Zealand Limited. “You” or “your” means the registered owner of the vehicle.
      2. TCSA comes with new Toyota vehicles. TCSA provides the following benefits:
        1. Capped Price Scheduled Servicing for the first four (4) years or 60,000km;
        2. Toyota Care Roadside Assistance for four (4) years;
        3. Two (2) Warrant of Fitness inspections as required by law, being one at the third (3) year, and one at the fourth (4) year from your new vehicles’ first registration); and
        4. The ability to extend the New Vehicle warranty to 150,000km/five (5) years, and the Toyota Care Roadside Assistance to five (5) years, if your new Toyota vehicle is serviced by an Authorised Toyota Store or Service Agent in accordance with Toyota New Zealand's recommended service schedule.
      3. Each of the above benefits are described in more detail below, as well as the conditions that apply in relation to each of them.
      4. TCSA applies in addition to the New Vehicle warranty.

Capped Price Scheduled Servicing

      1. Capped Price Scheduled Servicing means you will never pay more than the Capped Price amount for each scheduled service for 60,000kms or four years (whichever occurs first).
      2. The scheduled service plan applicable to your vehicle can be accessed your Service Record Booklet located in your Owner’s Manual Wallet or by visiting your Authorised Toyota Store or Service Agent.
      3. The price you will pay for each Capped Price Schedule Service is specified in your TCSA contract.
      4. You are able to pre-pay all or some of your Capped Price Scheduled Services by paying the amount specified in your TCSA contract multiplied by the number of services you wish to pre-pay (limited to the number recommended in your vehicle's scheduled service plan for 60,000km or four (4) years).
      5. If you sell your new Toyota vehicle and you have pre-paid for the Capped Price Scheduled Services, you can choose to either:
        1. cancel the remaining pre-paid services and have them refunded to you (a cancellation fee of $50.00 excluding GST may apply); or
        2. transfer the pre-paid services with the vehicle at the time of subsequent sale.
      6. Each Capped Price Scheduled Service includes the cost of parts that would normally be replaced as part of the Toyota New Zealand’s recommended service schedule (for example: oil, oil filter, and brake fluid are included in the price at no extra cost to you). Any additional items that need replacing (or repairing) will be at your cost (for example, tyres and brake pads are not include in the scheduled service price). Toyota Care Roadside Assistance

      1. Your new Toyota vehicle comes with Toyota Care Roadside Assistance for four (4) years. For more information, please refer to your Toyota Care Service Advantage booklet or visit your Authorised Toyota Store or Service Agent.

Warrant of Fitness Inspections

      1. You will receive two (2) Warrant of Fitness inspections (as required by law, being one at the third year, and one at the fourth year after your new vehicle is first registered). The inspections included with Toyota Care Service Advantage do not include any repairs that are required in order for your vehicle to meet the standards required to receive a Warrant of Fitness.
      2. TCSA does not include Certificate of Fitness inspections.

 

Platinum Warranty and Toyota Care Roadside Assistance Extension

      1. If your new Toyota vehicle is serviced by an Authorised Toyota Store or Service Agent in accordance with Toyota New Zealand's recommended service schedule for the duration of the New Vehicle warranty (100,000 kms or three (3) years, whichever occurs first), you will receive:
        1. an extension to your Toyota Care Roadside Assistance; and
        2. a Platinum Warranty.

      2. Toyota Care Roadside Assistance extension: The extension to your Toyota Care Roadside Assistance is for an additional year (to five (5) years total coverage).
      3. Platinum Warranty: A Platinum Warranty extends the benefits of the New Vehicle Warranty to 150,000kms or five (5) years (whichever occurs first). To receive the benefits of the Platinum Warranty you must continue to have your new Toyota vehicle serviced by an Authorised Toyota Store or Service Agent in accordance with Toyota New Zealand’s recommended service schedule.

Eligibility Conditions

    1. TCSA is included with new Toyota vehicles sold via the New Zealand Toyota Authorised Network including new Toyota vehicles sold for high usage purposes (including, but not limited to, vehicles purchased for use as a taxi, courier or shuttle service).
    2. TCSA is not included with new Toyota vehicles sold to, or sold as part of Toyota New Zealand Nationally Negotiated Government and Rental sales.
    3. TCSA is not included on Lexus or Used Toyota Vehicles.
    4. TCSA is not redeemable for cash or discount.
    5. Toyota vehicles that are used in competition, rallying or racing, or subjected to extraordinary use, such as (but not limited to) mining, severe off-road use, police or emergency operation, or are otherwise damaged or written off by neglect, accident or improper use will not be eligible for the extensions referred to in clauses 14, 15 and 16.
    6. TCSA only applies while your new Toyota vehicle is in New Zealand and becomes invalid if it leaves New Zealand.
    7. TCSA can only be redeemed at an Authorised Toyota Store or Service Agent. For clarity, any servicing carried out by non-Authorised Toyota Stores or Service Agents means that the vehicle will not qualify for the extensions referred to in clauses 14, 15 and 16 above.
    8. The TCSA Advantage entitlement attaches to the new Toyota vehicle itself and will be transferred to the new owner upon subsequent sale.

Money Back Options

  1. The Purchaser has the right to cancel the purchases under their Vehicle Offer and Sale Agreement (“Agreement”) and take advantage of the Money Back Option ("MBO") in clause 5 if the requirements in clauses 2 and 3 are met.
  2. The MBO is only available on a new vehicle, purchased from Toyota at an authorised Toyota dealership, which has not been significantly customised (for example, with wrapped screen printing, mechanical modification, or bespoke accessories not usually required by the typical customer or requiring permanent modification of the vehicle for fitment).
  3. The MBO is only available if the new vehicle (including Accessories, if any):
    1. is returned to the Dealer's premises by the Purchaser within seven calendar days of delivery;
    2. has travelled less than 500kms since it was delivered to the Purchaser;
    3. remains of a new vehicle standard, and the Accessories remain of a new standard, as determined by Toyota (or the Dealer on Toyota's behalf) in its sole discretion; and
    4. is free of all security interests and encumbrances, so that Toyota obtains good title free of security secured against the vehicle at the time of delivery to the Dealer
  4. Toyota may determine, in its sole discretion, that the requirements in clause 3(d) may be satisfied by Toyota entering into an arrangement with the Purchaser and the Purchaser's finance company for the purpose of releasing security secured against the vehicle.
  5. If the requirements in clauses 2 and 3 are met, the Purchaser is entitled to a refund of:
    1. all amounts paid by the Purchaser towards the price of the new vehicle (not including Accessories), less any amount payable by the Purchaser under clause 6(a);
    2. all amounts paid by the Purchaser towards the pre-payment of Toyota Care Service Advantage; and
    3. all amounts paid towards the price of any Accessory less:
      1. any costs associated with fitting the Accessories;
      2. any costs associated with removal of Accessories;
      3. an amount (as determined by the Dealer) to reflect the loss of value to any Accessories caused by the fitment and/or removal process; and
      4. any costs associated with the restoration of the new vehicle into the condition it was before Accessory fitment;
    4. all amounts paid towards the price of any extended warranty or service plan.
  6. In addition to the amount in clause 1, if the Purchaser takes advantage of the MBO the Dealer must do one of the following:
    1. return the Trade-in (if any) to the Purchaser, and invoice the Purchaser for the cost of any reasonable grooming, repairs or alterations to the Trade-in; or
    2. pay the Purchaser in cash the Net Allowance for Trade-in (if any), as stated on the front page of the Agreement.
  7. The Purchaser may incur break fees or other costs as a result of ending any finance arrangements for the new vehicle or Accessories (if any). The Purchaser is responsible for paying those fees and costs.

Toyota Certified Package

Eligible Vehicles:

Toyota Genuine Parts Warranty Conditions

This warranty applies to Toyota Genuine Parts as follows.

Service Parts Warranty

  1. These are Toyota or Daihatsu Genuine Parts fitted by a Toyota dealer or a participating Trade Garage to a vehicle during servicing or repair on a vehicle that is out of warranty.
  2. These parts have the following warranty cover:
    1. 24 Months/Unlimited Kilometres* against manufacturing or assembly defects. Commences from the fitment date.  
  3. However, if such parts have been fitted by a dealer while the vehicle remains under its new vehicle warranty cover then the following applies:
    1. 24 Months/Unlimited Kilometres* against manufacturing or assembly defects with cover commencing from the fitment date, or the remaining term of the new vehicle warranty, whichever is greater.
      Note: Where a part is fitted by a participating Trade Garage the following applies:
  4. Labour will be reimbursed at a set $45.00 plus GST per hour calculated using the Toyota flat rate manual time for fitting that part.
  5. When a valid claim is submitted for a warranty failure of such parts, TNZ will not be liable for any sublet costs incurred in replacing the failed part.

Counter Sales Parts Warranty

  1. These are Toyota Genuine Parts sold by a Toyota dealer to retail customers. Such parts have the following warranty cover.
    1. 12 Months/ Unlimited Kilometres* against manufacturing or assembly defects. Commences from the date of sale as validated by production of the sales receipt.
    2. When a valid claim is submitted for a warranty failure of such parts, TNZ will not be liable for any sublet costs incurred in replacing the failed part.

Accessories

  1. These are as Toyota Genuine Accessories that do not form part of the standard vehicle specification e.g. Towbars, Cargo barriers etc. Such parts have the following warranty cover.
  2. 12 Months/ Unlimited Kilometres* against manufacturing or assembly defects. Commences from installation date.

    1. The terms and conditions of the Service Advantage package apply to this offer;
    2. To receive and maintain the benefits of the warranty extension, the Toyota Hilux must:

Parts Invoicing

  1. Where the Buyer of the goods or service to which this invoice relates is an authorised Dealer of Toyota New Zealand Limited (TNZ), this invoice is subject to the Terms of Sale set out in the Dealer Sales and Service Agreement. 
  2. Where credit arrangements have been entered into, payment for the goods or service are due in accordance with those arrangements. In all other cases terms are strictly cash on delivery.
  3. Invoices not paid by due date may incur a penalty charge. 
  4. The Goods to which this invoice relates will be at the Buyers risk from the time they leave TNZ premises en route to the Buyer. 
  5. The Buyer grants TNZ a security interest in all present and future goods supplied by TNZ, as security for all amounts owing by the Buyer to TNZ and performance of all the Buyer's obligations under these terms and conditions. 
  6. Title to any particular goods will remain with TNZ until there are no longer any amounts owing to TNZ for those goods. 
  7. Until title to any particular goods passes to the Buyer, the Buyer will:
    1. hold those goods as TNZ's bailee;
    2. return those goods to TNZ on request; and
    3. hold any cash proceeds of those goods on trust for TNZ in a separate account.
  8. Even though title to any goods remains with TNZ, the Buyer may sell those goods on the Buyer's own account provided that:
    1. any such sale is conducted at arm's length and is for the full market value of those goods; and
    2. TNZ has not requested the return of those goods. 
  9. If the Buyer fails to comply with any term of these Terms and Conditions or any other agreement between TNZ and the Buyer, TNZ or TNZ's agent may exercise any and all remedies afforded to a secured party by Part 9 of the Personal Property Securities Act 1999 (PPSA) and enter any building or premises owned, occupied or used by the Buyer, to search for and take repossession of the goods. 
  10. The Buyer agrees that sections 114(1)(a), 117(1)(c), 133 and 134 of the PPSA will not apply on the enforcement by TNZ of any security interest created or provided for by this invoice. The Buyer also waives any rights it may have under sections 116, 119, 120(2), 121, 125, 129, 131 and 132 of the PPSA on such enforcement. 
  11. The Buyer acknowledges receipt of a copy of this invoice and waives any right it may have to receive from TNZ a copy of any financing statement, financing change statement or verification statement that is registered, issued, or received at any time in relation to this invoice. 
  12. The Buyer will not change its name without giving TNZ written notice of what its new name will be.

Toyota Customer Experience Survey – Vehicle Purchase & Service Customers

These terms and conditions are subject to the Toyota New Zealand General Terms and Conditions, unless specified below.

  1. To enter the Customer Experience Survey Prize Draw, entrants need to provide Toyota New Zealand with feedback on their experience with Toyota by completing one of the three different Customer Experience Survey Prize Draws: Vehicle Purchase Experience, Product Experience, and Service Experience (together known as the “Relevant Customer Experience Survey”).
  2. There is no cost to enter any of the Relevant Customer Experience Surveys.

15 Minute Try Out

Toyota New Zealand Limited (TNZ) is offering a promotion ‘Epic Hilux Weekend Adventure’ at the 2019 National Agricultural Fieldays®.

People will enter into the draw by spinning the wheel and/or providing TNZ with their first and last names, email and mobile contact details. One winner will be drawn and awarded a double pass for an Epic Hilux Weekend Adventure.

The Epic Hilux Weekend Adventure will take place in the South Island over 2 days during July or August 2019, trip dates to be confirmed by TNZ.

By entering in the competition you are deemed to have accepted the terms and conditions set out below. Winners will be required to sign a standard indemnity form prior to the commencement of the trip.

  1. Entry instructions and information on the prize offered form part of these terms and conditions.
  1. Entries are limited to one per person. Additional entries can be gained by spinning the wheel once only per person.
  1. The prize winner must hold a full NZ Driver’s License.
  1. Entry is open to New Zealand residents over the age of 18 at the time of entry, who currently reside in New Zealand.
  1. Employees (and their immediate families) of Toyota New Zealand Limited (TNZ), Toyota Finance New Zealand Limited or its affiliated dealerships, companies and agencies associated with this promotion are ineligible to enter.
  1. Entry to the competition is via the digital competition form on a reader supplied by satellite at the 2019 National Agricultural Fieldays® from 12-15 June 2019.
  1. The Epic Hilux Weekend Adventure prize package consists of:
    1. 2 day’s adventure with Toyota Ambassadors Marc Ellis and Willie Apiata in the South Island, NZ. TNZ reserves the right to change this location if required.
    2. Domestic travel arrangements and accommodation.
    3. Assorted food and refreshments during the trip.
  1. The prize will be drawn by Friday 21 June 2019 at TNZ, Palmerston North. The entrant drawn will win a double pass for an epic Hilux Weekend Adventure with Toyota Ambassadors Marc Ellis and Willie Apiata as outlined in the prize package.
  1. The winner will be notified by email or phone on Tuesday 25 June 2019. If the winner cannot be contacted by email or phone after three attempts another winner will be drawn.
  1. Acceptance of this prize by a prize winner constitutes acceptance for Toyota to use the winner’s name and photograph for publicity purposes including brand and social media.
  1. If the winner is unable to attend on the confirmed date, they will have to forfeit their place.
  1. Minimum age for the Epic Hilux Adventure Weekend is 18 years at time of trip.
  1. The Epic Hilux Weekend Adventure is not limited to days over a weekend and is subject to weather conditions. TNZ reserves the right to extend this trip over weekdays and will cover all associated costs such as extended accommodation, travel arrangements and meals.
  1. TNZ reserves the right to alter this offer at any time.
  1. Prize is not transferable or redeemable for cash or discount.
  1. Incomplete or incorrect entries are not eligible to win.
  1. To the extent permitted by law, Toyota New Zealand Limited and Authorised Toyota Dealers are not liable to any person, for any loss, damage, liability, cost, or expense incurred through use of the prize package or accommodation utilised and activities undertaken as part of the offer.
