You Are C-HR Competition 2017 Terms and Conditions

  1. These terms and conditions are subject to Toyota New Zealand’s General Terms and Conditions unless otherwise specified below.
  2. The C-HR Competition is valid from 1st April to 31st July 2017.
  3. The C-HR Competition is only available to New Zealand residents, over 18 years of age who hold a valid full New Zealand driver’s license, without any prior criminal convictions. For clarity, the ultimate winner of the prize, including any and all team members, must not have any prior criminal convictions.
  4. The You Are C-HR 2017 Competition is outlined as follows;
    • Potential participants will supply a casting video of themselves (or team) and what they propose they would use the day in the C-HR for.
    • All potential participants will then be checked and vetted and their task/activity selected and approved based on the campaign criteria at the discretion of Toyota New Zealand and their creative agencies.
    • The selected Contestants will be supplied the C-HR for 1 day on the confirmed date as per the production schedule. The Production Company will film the contestant throughout the day performing their pre-approved activity.
    • 1 day is classified as a maximum of 8 hours which will include 1 hour for lunch/crew and camera re-load. Toyota reserve the right to stop the vehicle at any stage for production requirements and crew breaks within this 8 hour allocation. If a contestant has finished filming their piece earlier than 8 hours, the car must be given back to the Production Company. The Production Company are to remain with you and the vehicle at all times.
    • The contestant must complete their pre-approved activity within 200kms of their point of residence unless being more than 200kms of their point of residence is fundamental to their idea and has been arranged prior to the shoot date.
    • The contestant is allowed to bring a team of up to 4 people (including themselves) if their activity requires this.
    • This content will be edited into videos – including a “feature video” from the content filmed throughout the day which will be posted to Toyota New Zealand’s Facebook page for the public to vote on.
    • The length of the featured content video will vary from contestant to contestant, depending on the type of content captured and the final length will be at the discretion of Toyota New Zealand and their creative agencies.
    • Each contestant’s feature video will be promoted on Toyota New Zealand’s Facebook Page and the same budget will be allocated to each contestant’s feature video to promote this on Toyota New Zealand’s Facebook Page.
    • Teaser content will also be posted onto Toyota New Zealand’s other social channels to drive engagement and the contestants will be able to share all content, including the “Feature Video” across their own social channels, although any “Likes” OR Facebook Reactions on these pages will not be counted towards the overall votes.
    • The Competition vehicle will be won by the contestant/team with the highest number of total votes collected on the Toyota New Zealand Facebook page within the voting period. Votes will be counted using Facebook Reactions and Likes as the Voting Mechanic. Each Like and Reaction will be pre-assigned a vote weighting by Toyota New Zealand and their creative agencies prior to the Competition live date. Toyota New Zealand and their creative agencies reserve the right to make the final decision regarding the Winner and no correspondence will be entered into.
    • Votes on any other Facebook Pages or Channels other than the Toyota New Zealand’s Facebook page will not be counted towards the overall votes.
    • The voting period will be split in to two periods. The first period is defined as 7 days (168 hours) from the time of posting each Contestant’s Feature Video. At the end of the 7-day period, voting will close for the first period and the total votes will be counted and recorded at this point in time. The second period is defined as a 48-hour period at the conclusion of all contestants first voting period where all participants have one last chance to collect votes to go towards their final tally. All votes counted in the first period and second period will be combined and the contestant with the most total votes is the final winner. Should two or more participants have the same number of final votes. A third period will begin, lasting 48 hours to select the ultimate winner.
    • If the winning contestant has more than one person in their team, then the team member who submitted the original application will be deemed the winner and will thus be awarded the final prize.
    • To enhance safety and preserve Toyota’s ability to present coverage as it sees fit, participants must not capture video content themselves while participating in the competition.  Any content captured by the contestant or their team during the 1 day shoot is prohibited from publication or sharing in any form unless they have the prior written authorisation of Toyota or its production company. For the avoidance of doubt, written confirmation is required for each individual piece of content.
    • Publication or sharing in any format of unauthorised content during or following the competition will immediately disqualify the competitor and their team from the competition and they will not be eligible to win or participate in the competition further.  Any prize that has been awarded will be returnable in the same condition it was received, or Toyota may require payment of equivalent value, at its election.
    • Publication or sharing in any format of any content or issuing any statement or publication that in any way or brings Toyota, it’s brand or its production partners into disrepute will make the contestant liable for any and all damage and costs suffered or incurred by Toyota or anyone else involved in the shoot or the competition. If the participant was the winner of the prize, they will be in breach of the terms of this agreement and will be required to return to Toyota the competition prize in the same condition it was received, or pay Toyota the equivalent value, at Toyota’s election.
    • Contestants are prohibited from using any form of paid promotion through Facebook or any other platform to assist their “feature video” in gaining views and/or votes. Failure to adhere will result in the entry being disqualified. Contestants may be asked to provide proof if requested by Toyota New Zealand.
    • All contestants agree to adhere to the Health and Safety requirements which will be provided to them prior filming and failure to do so may result in entry being disqualified.
    • Participants must not participate in the competition in any way impaired by the effects of alcohol, illicit drugs, non-prescription drugs, prescribed medications or any other substance.  The detection of any alcohol, illicit drugs, non-prescription drugs, prescribed medications or any other substance will immediately disqualify the participant and their team from the competition.  Participants, by entering into this competition, agree to be subject to a drug and/or alcohol test at the discretion of Toyota or its nominated partners at any time during this competition.
    • There will be a maximum of 10 participants filmed and eligible to win the car. One of the 10 will win the car.
    • If your task/activity is heavily reliant upon certain weather conditions and these conditions are not met on the day your shoot is scheduled, Toyota and its production company reserves the right to postpone or remove your shoot date from the production schedule so that no additional productions costs are incurred or disruptions made to other participants shoot dates in the production schedule.
    • Toyota will reserve the right to not feature your video should they decide it is not fit for use.

 

Competition prize is as follows;

  1. The 2017 Toyota C-HR in Sun Fusion used in the You Are C-HR Competition;
    • The winner of the above offer will be contacted after 31st July 2017
    • For clarity, the prize car will be the C-HR Sun-Fusion vehicle used throughout the duration of the Competition.
    • The prize car will be delivered to the winner's nearest Authorised Toyota Dealer for pick up.
    • The car will be delivered washed and groomed with a current registration, warrant of fitness, and a full tank of fuel.
    • Insurance of the car needs to be arranged by the winner.
    • The winner is prohibited to sell the vehicle for a period of 6 months from the date of ownership.

 

Usage of Selected Content and Images from each contestant;

  1. By entering this competition, every contestant agrees to the usage of photography and video taken during the day filming for future C-HR Campaigns, Toyota New Zealand advertising material across all media channels, not limited to; online stills and video, TV, Out of Home/Billboards, Print, Press, InStore, for a 12-month period. At the conclusion of this period, if Toyota New Zealand decide to continue using any or all of these assets a further contract with the individual(s) concerned will be entered into. All content will however be covered in perpetuity for historical housing on Toyota’s owned assets.
  2. Each contestant also agrees to not appear in any advertising for Toyota’s competitive brands for the 12 month period following the conclusion of the competition.

 

 

Additional General Terms and Conditions 

  1. Entry into the specific prize draw is deemed acceptance of these general terms and conditions and any specific or additional terms and conditions as outlined below.
  2. Employees of Toyota New Zealand Limited, Toyota Financial Services Limited, their advertising agencies, contractors, subsidiaries, Toyota dealership staff, and their immediate families are not eligible for this prize draw.
  3. Entry into this prize draw is deemed consent that you have opted into further communication from Toyota New Zealand Limited. You will have the ability to opt-out at any time by calling 0800 TOYOTA (0800 869682) or by emailing dialogue@toyota.co.nz.
  4. Photo ID may be required to claim the prize.
  5. Toyota New Zealand Limited cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.
  6. The prize winner will be notified within 5 working days of the draw and contacted via a call to the phone number provided or that made the entry.
  7. The person whose Facebook Account and/or casting application is used to submit the entry is deemed the entrant in the event of any dispute.
  8. Prizes are not transferable, exchangeable nor negotiable and are not redeemable for cash.
  9. While this prize draw will be administered with all reasonable care and skill, if Toyota New Zealand Limited or its designated agents are unable to make contact with any winner within 5 working days of a draw, Toyota New Zealand Limited reserves the right to declare that entry invalid and draw a new winner on the same terms and conditions as the original draw.
  10. Toyota New Zealand Limited reserves the right to substitute the prize for an equivalent or greater value if any prize becomes unavailable.
  11. Toyota New Zealand Limited accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries. Toyota New Zealand Limited does not warrant that the entry mechanism will be available at all times during the Promotion Period.
  12. Incomplete or incorrect entries are not eligible to win.

  14. Toyota New Zealand Limited reserves the right to disqualify entries in the event of non-compliance with these Terms & Conditions.
  15. Toyota New Zealand Limited reserves the right to change or alter these terms and conditions at any time.
  16. To the greatest extent permitted by law, neither Toyota New Zealand Limited nor any person or party associated with the promotion will be liable for any loss, damage or injury suffered or sustained (including, but not limited to, consequential loss) as a result of participating in this promotion or using any part of the prize, except for any liability which cannot be excluded by law.
  17. All decisions made by Toyota New Zealand Limited are final and no correspondence will be entered into.
